Your protections shouldn't depend on your location, but right now, they do. The surge in remote work has opened up new opportunities for millions of workers, but it has also exposed loopholes in labor law that currently allow companies to sidestep accountability.  Six of our members learned this the hard way when a Massachusetts startup refused to pay them for months of completed work. The writers thought the state’s labor laws — some of the strongest in the country — would protect them, especially since they believed they had been misclassified as contractors while working like employees. The Massachusetts Wage Act should have entitled them to protections, including holding the executives personally liable for unpaid wages.  But in court, a dangerous loophole emerged. Even though the company was based in Massachusetts, the state’s law didn’t always apply. Our members discovered their protections depended not on the work they did, but on clauses buried deep in the fine print. Unscrupulous companies can “forum shop,” shifting contracts to states with weaker protections, even if the company has no presence there and the worker doesn’t live there. That’s exactly what happened: contracts that had long specified Massachusetts law were quietly switched to California or Delaware. Other workers lost protection altogether, simply because their work was done remotely outside the state. Different tactics, same results: the protections disappeared. Our members fought for more than two years in court to finally win a settlement — but the loophole remains wide open. Companies can still withhold pay from remote workers without facing a single penalty. And yet, as remote work keeps growing, the law hasn’t kept pace. Late payments and non-payment are accelerating at an alarming rate. What happened to our members could happen to any of the millions of others working behind a screen. Shutting Down the LoopholeWe can’t keep fighting case by case. That’s why the National Writers Union is leading the fight for <a href="https://malegislature.gov/Bills/194/H2090" target="_blank">Massachusetts Bill H.2090</a>, legislation that would close this loophole for good and ensure remote workers have the same protections as those working in an office. Bill H.2090: <ul><li>Recognizes that remote work is now a permanent part of the economy. </li><li>Ensures that Massachusetts labor protections apply to anyone who works virtually for a Massachusetts-based company — no matter where they sit.</li><li>Stops companies from dodging responsibility by quietly switching contract jurisdiction to another state.</li><li>Requires any exceptions to be negotiated fairly, not buried in adhesion contracts.</li></ul>💪 Pushing on Two Fronts: Why Your Donation MattersOur members’ case has settled, but over two years of litigation came at enormous cost.
