I agree to the waiver:
This Release and Waiver of Liability ( “Release”) executed on _____ (date) is and between _____________________ (“Releasor”) and Olney Community Baseball Team INC (DBA Cropdusters Baseball), a nonprofit corporation organized under Section 501(c)(3) of the Internal Revenue Code and duly organized and existing under the laws of the State of Maryland (“Cropdusters”). The Releasor contemplated herein includes but is not limited to the following: camper, participant, volunteer, coach, independent contractor, and host family. Releasor understands that he/she is responsible for his/her own insurance coverage in the event of personal injury or illness as a result of his/her services provided to or participation with Cropdusters Baseball.
1. Waiver and Release: I, the Releasor, hereby release and forever discharge and hold harmless Cropdusters Baseball and its successors and assigns from any and all liability, claims, and demands of whatever kind of nature, either in law or in equity, which arise or may hereafter arise from the services I provide to or participation with Cropdusters Baseball whether for a specific event or otherwise. I understand and acknowledge that this Release discharges Cropdusters Baseball from any liability or claim that I may have against Cropdusters Baseball with respect to any claims, including but not limited to bodily injury, personal injury, illness, death, or property damage that may result from the services I provide to or participation with Cropdusters Baseball whether for a specific event or otherwise.
2. COVID-19: I, the Releasor, hereby agree and understand that Cropdusters Baseballs strives to act at all times in a manner consistent with the guidelines promulgated by the relevant leading research bodies and governmental agencies, thereby doing everything we can to protect the Releasor, our staff, and the public at large. I further understand that despite its efforts, the possibility exists that I may contract COVID-19 while at a Cropdusters Baseball event. If this should occur, as otherwise set forth herein, I hereby waive any and all claims as set forth in paragraph 1 above.
3. Insurance: I understand that Cropdusters Baseball does not assume any responsibility for or obligation to provide me with financial or other assistance, including but not limited to medical, health, or disability benefits or insurance. In accordance with paragraph 1 above, I expressly waive any such claim for compensation or liability on the part of Cropdusters Baseballs. By my signature below, if I am signing on behalf of a child, I hereby agree that my child has a valid health insurance policy in place.
4. Medical Treatment: I hereby Release and forever discharge Cropdusters Baseball from any claim whatsoever which arises or may hereafter arise on account of any first-aid treatment or other medical services rendered in connection with an emergency during my time spent with Cropdusters Baseball. If I am signing on behalf of a minor child, by signing below I verify my child is in good health and has my permission to participate in a Cropdusters Baseball program. I authorize the Cropdusters Baseball staff to act for me in securing medical treatment for my child in the event of injury or sickness. I understand that injuries occur in sports, and in accordance with paragraph 1 above, I expressly waive any such claim for compensation or liability on the part of Cropdusters Baseball.
5. Assumption of Risk: I understand I may be exposed to activities that may be hazardous to me. As a Releasor, I hereby expressly assume this risk of injury or harm from these activities and release Cropdusters Baseball from all liability in accordance with paragraph 1 above.
6. Photographic Release: I grant and convey to Cropdusters Baseball all right, title, and interests in any and all photographs, images, video, or audio recordings of me or my likeness or voice made by Cropdusters Baseball in connection with my participation with Cropdusters Baseball. I hereby grant Cropdusters Baseball permission to use such photos or videos while I participate in a Cropdusters Baseball program, for promotional purposes. As a client on behalf of my minor child, I hereby grant Cropdusters Baseball permission to use such photos or videos while my child participates in a Cropdusters Baseball program, for promotional purposes, so long as my child’s name is not affiliated with the photo or video.
7. Other: As a Releasor, I expressly agree that this Release is intended to be as broad and inclusive as permitted by the laws of the State of Maryland and that this Release shall be governed by and interpreted in accordance with the laws of the State of Maryland. I agree that in the event that any clause or provision of this Release is deemed invalid, the enforceability of the remaining provisions of this Release shall not be affected.
By signing below, I express my understanding and intent to enter into this Release and Waiver of Liability for Cropdusters Baseball willingly and voluntarily, and if applicable, on behalf of my child.*
