Applicant further understands that the use granted by the Bureau of Land Management is a License to Occupy only and is not coupled with an interest in the property. The Fern 45 retains the right to terminate this License to Occupy and this agreement/contract at any time during the terms of the applicant&rsquo;s use if applicant creates a nuisance to the Fern 45 by interfering with the orderly and successful presentation of the event or by breaching the Terms and Conditions, or without cause at the discretion of The Fern 45. Applicant understands that the purpose of The Fern 45 is to celebrate and raise funds for our veterans and agrees to support this purpose during the term of this License to Occupy. Applicant certifies that they have read and understand the application and will comply with all Terms and Conditions as follows: 1. Vendor applicants must pay required fees at time of application submittal. Vendor booth fees of $100 per 10x10 spot are non-refundable. Non-profit vendor booths supporting veterans will not be charged a booth fee. *ADDITIONAL CHARGE FOR WIFI See 13.* 2. Vendor booths may be set up Thursday, November 6th, Friday November 7th and/or Saturday November 8th Vendor booths must be set up, staffed, and operational by 12:00PM. Tear down can begin any time. 3. On Thursday, November 6th, vendors setting up booths will be permitted to unload products directly from their vehicles at the booth location. All vehicles must be relocated to the designated parking lot by 12:00 PM on November 6th.For booth setup occurring on Friday, November 7th, or Saturday, November 8th, vendors should anticipate transporting products from the parking lot to their booth using a wagon or by hand. 4. The Fern 45 will assign booth locations for each vendor. Vendors will receive exact location assignments on-site. You will receive a link for you to select your time slot for arrival. 5. Only one organization or vendor may use each booth space and must conduct business in their designated booth area only. 6. The Fern 45 crew and volunteers are unable to accept responsibility for any lost or stolen items, or for any equipment other than their own. It is recommended to use a tent with walls to cover your products at night should you choose not to break down your tent the first evening and set up again the following morning. 7. Vendors are welcome to camp along with event attendees.(Campsite will not be next to the booth area.) The Fern 45 reserves the right to revoke the camping permit of any individual and to further remove any person from the campgrounds in its sole discretion if it determines that such revocation and/or removal is in the best interest of the general public, event attendees, campers, the individual involved, and/or The Fern 45 and/or its crew or volunteers. 8. Vendors are responsible for cleaning up their booth area. 9. This is an outdoor event. Uneven terrain, inclement weather, and heavy wind gusts may occur. Plan on securing your booth for wind using weights on all 4 corners with a recommended 40 lbs. of weight per leg using items such as cement blocks, water, sand, stakes, etc. 10. Vendors requiring electrical power must bring their own quiet generator. 11. Non-booth holders may NOT distribute merchandise or fliers of any kind. Vendors are welcome and encouraged to share any event posts that The Fern 45 publishes on social media sites. PLEASE DO NOT create any Facebook events for The Fern 45. Creating a duplicate event negatively impacts media analytics and can create skewed data for grant reporting purposes. 12. Vendors agree to allow use of video and photography taken by The Fern 45 crew and volunteers for promotional purposes. Any photos taken by The Fern 45 are property of The Fern 45. 13. Wi-Fi will be available for vendors for an additional fee of $50. Please be prepared to use your own Wi-Fi connection should the provided connection go down. 14. It is the responsibility of all vendors to obtain all permits, licenses, insurance, etc. The Fern 45 reserves the right to prohibit the sale or distribution of materials that may be illegal or considered offensive to others.
