Box 3147 Seminole, Florida 33772.  The Kiwanis Club of Seminole Car Raffle is a fundraising activity in support of the Seminole Warhawk Band Aides Boosters, hereafter referred to as the Seminole High School Band Boosters or SHSBB, which is a not-for-profit, 501(c) 3 charitable organization with a company address of 8401-131st Street N, Seminole, FL 33776.  The SHSBB has been incorporated as a non-profit corporation for furthering and supporting the band programs at Seminole High School in cooperation with the Band director and Principal of Seminole High School.  The Prize: Each ticket holder will be entered into the Kiwanis Club of Seminole Car Raffle drawing on Saturday, September 28, 2024, which will commence at the 47th Annual Seminole Sound Spectacular in the stadium of Seminole High School at approximately 6:00 p.m.  One Grand Prize winner will be chosen from all ticket holders, and the Grand Prize winner shall receive a 2024 Volkswagen Jetta 4 Door Sedan. The maximum price paid to the dealership by the Kiwanis shall be no more than $23,767.00. THERE ARE NO CASH REFUNDS, AND NO OTHER SUBSTITUTIONS.  If SHSBB determines that Kiwanis Club of Seminole has not received contributions for 800 tickets by 5:00 P.M. on Friday, September 28, 2024, the Grand Prize shall instead be a 50/50 drawing whereby the Grand Prize Winner shall receive an amount equal to fifty percent (50%) of all ticket contributions made and Kiwanis Club of Seminole receiving fifty percent (50%) which shall be remitted to SHSBB. The total 50/50 Grand Prize awarded to the winner shall not exceed $23,767.00. Volkswagen of Wesley Chapel assumes responsibility for the cost of vehicle registration fees and taxes for the Grand Prize Winner. The Grand Prize winner assumes and must pay all other fees and charges associated with the   vehicle. In addition, all costs of car ownership, such as (without limitation) insurance, are the Grand Prize winner's sole responsibility. If the cash prize is awarded instead of the automobile, tax issues may apply. The winner in case, automobile or cash, should consult with his/her financial or tax advisor. Kiwanis Club of Seminole assumes no responsibility for a prize winner's tax obligations. This offer is void where prohibited by law and all federal, state and local laws and regulations apply. The winner must have proper identification when claiming the vehicle (a valid state driver’s license) and appropriate insurance as determined by the Volkswagen of Wesley Chapel Dealership, located at 26500 Silver Maple Pkwy, Wesley Chapel Florida 33544.   If the winner elects not to accept the vehicle, no substitution or exchange for cash or other goods will be provided.  Kiwanis Club of Seminole is not responsible for the vehicle’s quality, nor shall it have any responsibility once the vehicle has been conveyed or delivered to the winner. Kiwanis Club of Seminole makes no guarantee that the Internal Revenue Service (IRS) will accept any stated value of any automobile for the purpose of determining any income tax that may be due. SHSBB takes no responsibility for any tax liabilities. The Grand Prize winner is strongly advised to seek professional legal and tax advice. Award of the Grand Prize could have material adverse consequences on the Grand Prize winner including without limitation, with respect to taxes, income, government entitlements or other benefits, or other legal, financial or other matters. Eligibility: Only licensed drivers (license cannot be suspended), 18 years of age and older (at time of donation) are eligible to participate and enter. Kiwanis Club of Seminole reserves the right to disqualify any entrant for violation of these Official Rules, any applicable laws, or who makes any misrepresentations relative to this drawing of chance. Raffle tickets may not be purchased in the name of a business, trust, corporation, or other entity, or wherever prohibited by applicable law. Prize winners may be required to sign an affidavit of eligibility. Winning ticket holders will be responsible for reporting and payment of all taxes or withholdings associated with receiving prizes, and must be eligible in terms of age, citizenship and other tax/financial criteria to receive prizes awarded. Members of the Kiwanis Club of Seminole, the Kiwanis Club of Seminole Executive Board, their spouses, and family are allowed to participate and are eligible to win the Grand Prize. Drawing will be done electronically by a random number generator. Entry and Tickets: No purchase or contribution is necessary to participate in the Raffle. However, the suggested minimum donation is $40 per ticket. The $40 is payable to Kiwanis Club of Seminole.  A maximum of 5,000 tickets will be issued. Ticket sales will cease when that number of qualified entries is reached. The IRS states purchase of raffle tickets are not tax-deductible contributions. Only ticket holders with validly obtained tickets are eligible to participate in the Raffle. Ticket requests will be accepted (in person) until 5:00 p.m. on Saturday, September 28, 2024. Tickets may sell out before that time. NO REFUNDS AVAILABLE. Kiwanis Club of Seminole assumes no responsibility for lost, late, misdirected, or non-delivered mail or other failure to deliver tickets prior to any deadline. Kiwanis Club of Seminole reserves the right to limit the number of tickets distributed to each person. The $40 suggested donation for the Kiwanis Club of Seminole Car Raffle can be made by:1) Check or cash, in person at events or directly through individual ticket sellers. (All checks must be made out to the Kiwanis Club of Seminole) Any returned or canceled checks will automatically disqualify the ticket holder from winning the Grand Prize. 2) By credit or debit card through this online link. To enter without a donation, send a letter stating that you wish to obtain a “no donation” entry with your name, address and phone number and a stamped, self-addressed envelope to: SHSBB located at 8401-131st Street N, Seminole, FL 33776. Post mark may not be later than fourteen (14) days prior to the date of drawing on September 28, 2024. Only one request per household.   Selection of Winner: The Grand Prize drawing for the Kiwanis Club of Seminole raffle car will be held, September 28, 2024, drawn at random at approximately 6:00 p.m. at the 47th Annual Seminole Sound Spectacular at Seminole High School Stadium, at 8401-131st Street, Seminole, FL 33776, except this date and all other dates stated in these rules may be extended in the Kiwanis Club of Seminole’s absolute discretion. The winner does not need to be present to win. For the Grand Prize winner to receive the Grand Prize (subject to the other provisions in these rules), if not present at the drawing; the Grand Prize winner must elect to receive the car by delivering written notice of that election to SHSBB or Kiwanis Club of Seminole by 3:00 p.m. on October 12, 2024. If the SHSBB or Kiwanis Club of Seminole does not receive that notice, or if the winner is deemed to be ineligible, then the Grand Prize winner forfeits his or her prize and an alternative Grand Prize winner will be drawn for such prize. The subsequent winner must claim his or her prize within fourteen (14) days after notice of the award. If the subsequent winner does not claim the prize within such fourteen (14) day period, that winner will be deemed to have forfeited his or her prize and another winner will be selected in the same manner as set forth herein until a winner is determined.
