(Operator) AND CITY OF CLAREMONT (Owner) DBAARROWHEAD RECREATION AREA AND ITS AGENTS, VOLENTEERS AND EMPLOYEES (HEREAFTER THE "SKIAREA"), FROM ANY AND ALL LIABILITY TO ME OR MY CHILDREN RESULTING FROM THE SKI AREA\'S ACTS OFNEGLIGENCE. I understand that the Ski Area is not responsible for the consequences of its own negligence, that is, its failure to use reasonable care in any way in the operation of this facility, as well as the installation, maintenance, selection, adjustment and use of this rental equipment. I acknowledge that I am freely and expressly assuming and accepting any and all risks of property damages, personal injury or death as the user of this equipment on my own behalf and on behalf of my minor children that I am responsible for.I UNDERSTAND  AM AWARE THAT SKIING, SNOWBOARDING AND SNOW TUBING IS A HAZARDOUS ACTIVITY. I understand that skiing, snowboarding, and snow tubing and the use of related equipment involves a risk of injury to any and all parts of my body. I hereby freely and expressly assume and accept responsibility for any and all risks of injury or death while participating in this activities. I agree to hold harmless and indemnify the Ski Area for any and all loss or damage I may cause to other persons or property while engaged in these activities. This includes, but is not limited to, any and all claims for personal injury, death and/or property damage that may arise out of my use of any equipment, regardless of whether such loss or damage is caused to me or to others. This agreement is governed by the laws of New Hampshire and any claim brought against Arrowhead Recreation Club Inc. and City of Claremont d/b/a Arrowhead Recreation Area must be brought in New Hampshire. If any part of this agreement is determined to be Unenforceable, all other parts shall be given full force and effect. I agree that there have been no warranties, expressed or implied, which have been made to me beyond the information written on this form. I, the undersigned, acknowledge that I have read this agreement and release of liability and I understand its contents. I understand that my signature below expressly waives any rights I or my children may have to sue the Ski Area for injuries and damages.
