ENTER FOR A CHANCE TO WIN your choice of A NEW GMC TERRAIN, any New or Used Vehicle from Williams GMC up to $30,000, or $20,000 cash! 2nd Place Prize: 36" Blackstone Griddle 3rd Place Prize: $250 Cash. Tickets are $10 each. A maximum of 15,000 tickets will be sold. *Important Disclaimer* Please note: The Winner of the Grand Prize will be responsible for all taxes which need to be remitted to the IRS. An amount of 24% of the fair market value of the prize must be paid to Ardrey Kell Band Boosters before the prize will be released to the winner and the winner must sign form W2-G indicating receipt of gambling winnings. Ardrey Kell Band Boosters will then identify the winner to the IRS and remit the 24% as required by law for gambling winnings withholding. Grand Prize will be awarded if tickets sold exceed 120% of the Vehicle's MSRP (Vehicle MSRP = $33,000, 120% of MSRP = $40,000). If ticket sales do not exceed $40,000, the raffle will convert to a 50/50 prize where Winner will receive 50% of the ticket sale proceeds and the remaining 50% will be retained by the Ardrey Kell Band Boosters. If applicable, the 24% gambling withholding taxes will be deducted from the 50/50 prize or the $20,000 grand prize, if selected and the winner will sign a W2-G to indicate receipt of gambling winnings. ARDREY KELL HIGH SCHOOL BAND BOOSTERS VEHICLE RAFFLE FUNDRAISER TERMS AND CONDITIONS The Ardrey Kell High School Band Boosters (“AKHSBB”) operates strictly for charitable purposes within the meaning of Section 501(c)(3) of the US Internal Revenue Code. The 2023 AKHSBB Vehicle Raffle (“Raffle”) is conducted for the purpose of generating funds for the Ardrey Kell High School Bands. 1. ELIGIBILITY. Each entrant, by entering the Raffle, agrees to abide by all of the rules and conditions contained herein, as well as all applicable local, state, and federal laws and regulations. Entrant further agrees to release AKHSBB and its officers, volunteers, and members from any and all liability with respect to all aspects of the Raffle including, but not limited to, the selection process and all activities associated with the prizes awarded. The Raffle is open to any eligible person residing in a state, county, or city where the Raffle is not prohibited. Officers of the AKHSBB, the Band Directors, and their immediate family members are not eligible to participate in the Raffle. Immediate family members are defined as spouse, children, or any extended family living in the same household. Entrants must be of 18 years of age or older, of legal competence, and a legal resident of the United States of America. 2. TICKET DISTRIBUTION. Raffle tickets will be sold exclusively through an online platform, Zeffy. Each ticket will cost $10. No more than 15,000 Raffle tickets will be sold. Raffle tickets will be sold until the earlier of Friday October 20, 2023 at 7:00 PM Eastern Standard Time or such time as the total designated number of Raffle tickets (15,000) have been issued, whichever comes first. Winners will be required to produce identification matching the full name entered in the ticket entry form. Raffle tickets have no cash or redemption value. 3. GRAND PRIZE. The Grand Prize is the winner’s choice of a NEW GMC Terrain from Williams GMC, any new or used vehicle sold by Williams GMC with a value up to $30,000 or $20,000 cash. If winner selects the New GMC Terrain, the color may be determined by Williams GMC. The awarded NEW GMC Terrain will include standard features of the SLE model. Options may be added at Grand Prize Winner’s sole expense. Pricing for options will be provided by Williams GMC. The Grand Prize Winner must negotiate directly with Williams GMC for any additional options and upgrades. AKHSBB will not act as an agent on behalf of the Grand Prize Winner regarding options. 4. OTHER PRIZES. 2nd Place Prize is a 36” Blackstone Griddle. 3rd Place Prize is $250.00 cash. Second and third place drawings will be held concurrent with the Grand Prize Drawing and will be selected from all tickets that are sold by 7:00 PM Eastern Standard Time on Friday, October 20, 2023. 5. RESPONSIBILITIES OF GRAND PRIZE WINNER Grand Prize Winner will be required to provide AKHSBB with a valid social security number and must complete all IRS and other forms requested by AKHSBB prior to delivery of their prize. Failure to do so within thirty (30) days of request shall result in automatic forfeiture of Grand Prize Winner’s prize. The MSRP of the vehicle is includible in Grand Prize Winner’s gross income and will be subject to reporting by AKHSBB to the IRS. The Grand Prize Winner is responsible for all licensing, registration, title, license plate, dealer preparation, shipping, and all other fees, and local, state, and federal taxes, including without limitation, all applicable sales, use, luxury, income, and special taxes. Grand Prize Winner must complete and sign a W-2G form and all required tax forms, verify his/her social security number, and deliver a cashier’s check or bank certified check for 24% federal income tax withholding based on the fair market value of the Grand Prize vehicle (Estimated MSRP of $33,000.00) or 24% of the New/Used Car Credit (Value of $30,000) to AKHSBB prior to release of the vehicle. Grand Prize Winner is responsible for any backup withholding required by the IRS. AKHSBB will submit the taxes collected to the IRS on behalf of the Grand Prize Winner. If Winner selects the GMC Terrain, Grand Prize Winner must also show proof of a Driver License and proof of insurance. AKHSBB will file a form W-2G with the IRS to report the value of the prize won and the taxes paid by the Grand Prize Winner. Grand Prize Winner will receive a copy of the W-2G. Grand Prize Winner should consult a tax professional. 6. WINNING CHANCES. A maximum number of 15,000 tickets will be sold. Chances of winning prizes depends on the number of tickets sold, up to 15,000. 7. DRAWING. The Grand Prize Winner (and Second and Third Prize Winners, if applicable) will be determined by a generating a random number via random.org from all eligible ticket entries sold by the entry deadline. The Grand Prize drawing will be held at Ardrey Kell High School at the last home football game on Friday, October 20th, 2023 and announced during half time or immediately after the game. If the game is postponed or canceled, the drawing will still occur and the Winners will be announced via social media including the Band’s Facebook page. Drawing will be supervised by members of the AKHSBB Board. All tickets sold by the date and time of the drawing as noted above will be eligible for the drawing. An Alternate Winner name will be drawn and Alternate Winner will be contacted by AKHSBB in the event that the original Winner is deemed ineligible. Winners need not be present to win. 8. MODIFICATION OR CANCELATION OF DRAWING. AKHSBB reserves the right to cancel or modify the Raffle at any time. If 120% of the Grand Prize MSRP value is not reached via ticket sales by October 20, 2023, AKHSBB will modify the Raffle to a “Fifty/Fifty” model whereby the Grand Prize is valued based on a Fifty Percent (50%) split of the remaining net proceeds (income less expenses) equally between the Grand Prize Winner and AKHSBB. If all available tickets are sold before the scheduled Grand Prize drawing date (the raffle is “sold out”), AKHSBB reserves the right to end the raffle early and hold the Grand Prize Drawing at a date earlier than scheduled publicized drawing date. 9. WINNER. Winners will be notified by an AKHSBB representative by phone, email, or by mail based on the information provided at the time of ticket purchase. Name of Winners will be available to all Media and will be listed on the Ardrey Kell High School Band website and social media. Grand Prize Winner agrees to allow AKHSBB to use their name, likeness, and any statements made by him/her regarding the prize for advertising or publicity purposes without compensation. Grand Prize Winner agrees to be photographed with the Grand Prize within sixty (60) days of the drawing. Grand Prize Winner may be required to complete and return an affidavit of eligibility and liability release. Failure to do so if requested or if Winners otherwise fail to comply by these rules and/or to make arrangements to claim his/her/their prize within thirty (30) days of notification, the winning entry will be voided and the prize will be forfeited. 10. AWARDING OF GRAND PRIZE. A valid social security number matching the name of Grand Prize Winner must be presented by the Grand Prize Winner. 11. AUTHORITY AND CONTROL. The decision of the AKHSBB shall be final in all matters concerning the Raffle. The Raffle is subject to the laws of the State of North Carolina. Void where prohibited by law. AKSHBB reserves the right to amend, modify, or otherwise alter these rules at any time. 12. OVERSIGHT. THE 2023 AHSBB Vehicle Raffle is overseen by the Ardrey Kell High School Band Boosters in Charlotte, NC.
