FACC highlights of 2025 include: Last year the District Judge ruled on our 2020 lawsuit and while we are pleased withsome of the results, we are not satisfied. FACC continues to believe the time has cometo resolve these issues after 15 years of legal wrangling so government resources canbe better focused on helping and encouraging Americans to save for retirement.In addition, FACC along with other trades have successfully completed a 50-stateadoption of the NAIC Best Interest Model. FACC worked tirelessly for 10 years toensure that the model was workable for independent insurance professionals andadministratively feasible for the carriers with whom they work. FACC spent many hoursvisiting and speaking with over 36 state insurance commissioners and was activelyengaged in all NAIC discussions during the development of the model. More than that,FACC worked on a state-by-state basis to ensure that the independent distributionelements we fought so hard to incorporate were retained and adopted in their entirety. Looking ahead:We will, of course, continue our legal efforts until we win in the courts. Here is anabbreviated list of the important work we will tirelessly take on in 2026. * &nbsp; &nbsp; FACC is actively working with states to ensure that new privacy laws andindependent contractor rules recognize the unique attributes of independentdistribution and do not hinder or disrupt our thousands of small businesses whoserve consumers across the nation to protect consumer choice of guaranteedinsurance solutions. * &nbsp; &nbsp; We will continue to work with states to increase their recognition of alltypes of LTC products available to employees through independent agents andthe IMOs and BGAs who serve them. * &nbsp; &nbsp; The NAIC is actively working on a full review of the Annuity Illustration Model andwe have been told by various departments that the formal charge to their Life andAnnuity Task force will be coming next spring. *&nbsp; &nbsp; &nbsp;Lastly, we are paying close attention to states as they continue to implement andenforce the Suitability Best Interest requirement to ensure that they adhere to thelaws they adopted. We will have lots to report on at our annual Independence Summit next fall. Look fordates and locations to be announced soon!
