If you have chosen to request adjustments to the waiver, you must contact us before the clinic begins for consideration.&nbsp; WAIVER AND RELEASE OF LIABILITY PLEASE READ CAREFULLY! &nbsp; THIS IS A LEGAL DOCUMENT THAT AFFECTS LEGAL RIGHTS This Waiver and Release of Liability (&ldquo;Release&rdquo;), is executed by the undersigned on behalf of himself or herself, and, if applicable, as parent or guardian of a minor child (&ldquo;I&rdquo;) in favor of Capital Off Road Pathfinders, Inc., a Wisconsin non-stock corporation and its officers, directors, members, employees, volunteers and agents (collectively, the &ldquo;CORP&rdquo;). This Release is given in connection with my, and/or my minor child&rsquo;s, participation in a group mountain biking training class instructed by CORP (&ldquo;Class&rdquo;).&nbsp; I understand that participating in the Class will involve biking on dirt trails containing rocks, boulders, roots from trees, bushes or other vegetation, signs, sharp turns, sudden drops, and manmade technical features such as ramps. I understand that participating in the Class is a hazardous activity that could result in bodily injury, personal injury, illness, or death such as broken bones; strains; sprains; bruises; concussions; heart attack; dehydration; heat exhaustion; loss of limbs; or partial or complete paralysis. Such bodily injury, personal injury, illness, or death in connection with participation in the Class &nbsp;could arise from or be caused by: tripping, slipping, sliding, falling, or otherwise losing balance due to the conditions of the trail, the presence of other trail users or spectators, or the presence natural or manmade objects; failure to wear protective gear such as a helmet and body pads; failure to properly maintain my bicycle in good condition and repair; collision with other trail users, spectators or with natural or manmade objects on or near the trail; rescue efforts by others; slippery, wet or uneven surfaces; changing weather conditions; bicycle tires becoming caught on natural or manmade objects; myself or others riding the bicycle at an inappropriate speed; or the lack of my ability and skill to ride a bicycle on the trail. For good and valuable consideration, including participating in the Class, I hereby freely, voluntarily, knowingly and without duress execute this Release under the following terms: WAIVER AND RELEASE:&nbsp; I freely, voluntarily, knowingly, and without duress waive and release CORP and its respective members, officers, directors, employees, and agents from any liability or claim that I or my spouse, heirs, assigns, and estate may have now or in the future with respect to any bodily injury, personal injury, illness, or death that may result from participating in the Class caused by my negligence, the negligence of another person using the trail, the negligence of third parties, or the negligence of CORP or its members, officers, directors, employees, and agents. &nbsp;However, this Release does not release and discharge CORP, and its members, officers, directors, employees and agents from a liability or claim for harm caused by the intentional or reckless acts of CORP or its members, officers, directors, employees, and agents. ASSUMPTION OF RISK: &nbsp;I understand that participating in the Class may be hazardous, and that such hazards could include bodily injury, personal injury, illness, or death. I further represent that I, and my minor child (if applicable) have the skills and experience to participate in the Class in a safe and proper manner. &nbsp;As provided in this Release, I hereby expressly and specifically assume the risk of injury or harm to myself and my minor child (if applicable) arising from participating in the Class caused by my negligence, the negligence of others on the trail, the negligence of third parties, and the negligence of CORP, and its members, officers, directors, employees, and agents. &nbsp;I have reviewed and understand all of the terms and conditions of this Release. I believe the terms and conditions of this Release are reasonable.&nbsp; Additional Provisions: I expressly agree that this Release is intended to be as broad and inclusive as permitted by the laws of the State of Wisconsin, and that this Release shall be governed by and interpreted in accordance with the laws of the State of Wisconsin. &nbsp;I agree that in the event any clause or provision of this Release is held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining clauses or provisions of this Release, which shall continue to be enforceable. **Opportunity to Negotiate: I want to negotiate the terms and conditions of this Release before i proceed with participating in the class. i understand that i must contact corp&rsquo;s attorney at (608) 259-2674 and any changes must be in writing and expressly approved by corp**. ✅ &nbsp; &nbsp; I have been offered the opportunity to negotiate the terms and conditions of this release. &nbsp;however, I choose to accept the terms and conditions of this Release as they are, without negotiation.
