Digital Image Order Form and One-Time Usage Agreement

Terms and Conditions

1. Permission & Usage

• Permission is granted for one-time use only as described in the Intended Use section, with no other rights. Any subsequent use (including subsequent editions, paperback editions, foreign language editions, etc.) constitutes reuse and must be applied for in writing. Additional fees may apply.
• The purchase of a photographic image does not carry the right to make reproductions in any form without express consent from the Ridgefield Historical Society.
• All rights to the image(s) remain the property of the Ridgefield Historical Society. The Society retains all negatives and reserves the right to deny reproduction if it would adversely affect the preservation of historic materials.
• The Society does not surrender its right to publish the image(s) or grant permission to others for usage.

2. Credit & Attribution

• Each reproduction must be credited: "From the collection of the Ridgefield Historical Society, Ridgefield, Connecticut."
• Printed materials and web use must include the photographer’s name (if known) with the credit line.
• Films, filmstrips, slide presentations, and video productions must include the credit in the production credits.
• Exhibitions must credit each image on a label within the display area.
• Payment of usage fees does not exempt the user from the credit line requirement.

3. Prohibited Uses & Restrictions

• Users may not reproduce, sell, give, loan, or permit others to use, reproduce, or distribute the image(s). Additional copies must be purchased from the Ridgefield Historical Society.
• Images for Internet use must not exceed 100 dpi, regardless of image resolution upon transfer.
• No image may be altered, cropped, colorized, retouched, digitally enhanced, or manipulated—including via AI—without prior written consent from the Ridgefield Historical Society. Any altered or detailed image must be labeled "DETAIL".
• Reproduced materials shall not imply endorsement by the Ridgefield Historical Society of any product, enterprise, or viewpoint.

4. Copyright & Liability

• Copyrights of all photographs remain the property of the Ridgefield Historical Society unless otherwise noted.
• Users assume all responsibility for potential copyright infringement and invasion of privacy related to their use of images.
• If the Ridgefield Historical Society does not hold the copyright for a requested image, the user must seek permission from the legal copyright holder and assumes all liability.
• The user agrees to indemnify and hold harmless the Ridgefield Historical Society, its officers, employees, and agents from any claims regarding copyright ownership. In the event of litigation, the user agrees to pay any legal fees incurred by the Society.

5. Fees & Compliance

• Permission is valid only for the individual, institution, or company to whom it is specifically issued and is not transferable.
• Permission is granted only after all applicable fees have been paid. Failure to pay the required fees means that permission has not been granted.
• A complimentary copy of any publication or production featuring the digital image(s) must be provided to the Ridgefield Historical Society.

• All fees support the mission of the Ridgefield Historical Society to preserve, interpret & foster public knowledge of Ridgefield’s historical, cultural & architectural heritage.
