Browne's Field Pavilion Rental. If you cancel within 4 days of your event, your security deposit will be forfeited. Any rental areas/equipment not specifically reserved as part of this Agreement may be used by other parties. Lessee agrees to indemnify, defend and hold Harsen’s Island St. Clair Flats Association (“HISCFA”) and its respective officers, agents, members and employees of any sponsoring organization, underwriters, individually or collectively (the “Indemnified Parties”), harmless from and against and pay and reimburse HISCFA and the Indemnified Parties for all fines, penalties, liabilities, losses, claims, damages and expenses, including court costs and attorney fees incurred or suffered as a result of or relating to Lessee’s use of HISCFA’s Rental Areas. By completing the following request for rental you are hereby agreeing to the following: Security Deposit: Security Deposit is due to HISCFA on the date this Agreement is signed. The Security Deposit will be refunded to Lessee if the Rental Areas/Equipment are undamaged and have been properly cleaned and equipment returned to designated storage area as determined by HISCFA. Lessee shall be liable to HISCFA for any damages sustained to the Rental Areas in excess of the Security Deposit. Entire Agreement:The Agreement sets forth the entire agreement between HISCFA and Lessee and may not be modified except in writing and signed by both parties. Lessee shall not assign this Agreement. Use: Rental of Browne’s Field and/or pavilion is prohibited for use directly or indirectly in any political campaign on behalf of (or in opposition to) any candidate for elective public office (IRS.gov Restriction 501(c)3 Organizations). HISCFA reserves the right to refuse to rent the Rental Areas/Equipment at its discretion. Browne’s Field, the Rental Areas/Equipment and facilities are for the use and enjoyment of members and non-members of HISCFA. The Rental Fees and Security Deposits set forth in the Agreement are established for the purpose of supporting the maintenance and upkeep of the Rental Areas/Equipment and the surrounding area. In order to use the Rental Areas/Equipment, a party must enter into this Agreement with HISCFA. If a conflict arises for use of the Rental Areas/Equipment between a member and a non-member of HISCFA, the member of HISCFA shall be given priority for use of the Rental Area. Portable Toilets: There are two portable toilets at Browne’s Field at all times. However, HISCFA strongly suggests if you have a party of over 50, additional portable toilets should be rented. Additional portable toilets will be at the Lessee’s expense and responsibility and can be rented by contacting ABC Rentals at: (810) 794-5678. Spraying for Mosquitoes: If you plan a party that requires mosquito management, HISCFA recommends you have the grass sprayed around the pavilion. This will also be at Lessee’s expense and responsibility. ABC can also be called for this service at: (810) 794-5678. Condition of Premises: Lessee is responsible for all activities in the Rental Areas during the Date of Use. Use of the Rental Areas/Equipment by Lessee is at Lessee’s own risk. HISCFA reserves the right to have a “caretaker” at Browne’s Field and in the Rental Areas to assure compliance with the provisions of this Agreement and the rules of Browne’s Field and the Rental Areas. The “caretaker” may cause the removal of any or all persons not complying with the rules of Browne’s Field and the Rental Areas or this Agreement. Lessee is responsible for returning the Rental Areas/Equipment to the same condition prior to Lessee’s Date of Use. All temporary trim, decoration, signs, temporary structures (such as tents or caterers’ equipment) shall be removed by Lessee at the end of Lessee’s Date of Use of the Rental Areas. Trash Removal: Trash is the responsibility of the Lessee. All trash must be removed from the field at the end of the party or event. Five trash bags will be provided, but Lessee is responsible for additional bags if needed. Illegal Activity: Lessee agrees to abide by the laws of the Township of Clay, the County of St. Clair and the State of Michigan. Lessee agrees that Browne’s Field and the Rental Areas/Equipment will not be used for gambling, illicit or illegal purposes. Any illegal activity at Browne’s Field or the Rental Areas will result in termination of this Agreement and the immediate removal of any or all persons not complying with the law.
